These Terms of Service (“Terms”) govern your use of the Artrecast website, services, and any related platforms (collectively referred to as "Platform"). By accessing or using our Platform, you agree to be bound by these Terms. If you do not agree with any of these Terms, please do not use our Platform.

1. Eligibility

To use our Platform, you must be at least 18 years old or the age of majority in your jurisdiction. By agreeing to these Terms, you represent and warrant that you meet the eligibility requirements.

2. Account Registration

You must create an account to access certain features of our Platform, such as buying, selling, or minting NFTs. When creating an account, you agree to provide accurate, complete, and up-to-date information. You are responsible for maintaining the confidentiality of your account login information and agree to notify us immediately of any unauthorized use of your account.

3. Use of the Platform

You agree to use the Platform only for lawful purposes and in accordance with these Terms. You may not:
Engage in fraudulent or illegal activity.
Upload, create, or distribute content that infringes on the intellectual property rights of others.
Use the Platform to harass, abuse, or harm other users.
Interfere with or disrupt the functioning of the Platform, including any security measures.

4. Intellectual Property

The Platform and its contents, including but not limited to text, graphics, logos, images, software, and design, are the intellectual property of Artrecast its licensors and are protected by copyright, trademark, and other laws. You may not copy, reproduce, or modify any part of the Platform without explicit permission.

5. NFT Transactions

Buying and Selling: You can buy, sell, and transfer NFTs through the Platform using your connected digital wallet. All transactions are final and non-refundable.
Ownership: When you purchase an NFT on the Platform, you receive ownership of the token, but you do not automatically obtain any intellectual property rights to the underlying content unless explicitly stated by the creator.
Minting NFTs: Creators who mint NFTs on the Platform must own the rights to the content they upload. You represent and warrant that your content does not infringe on the rights of any third parties.

6. Fees

We may charge transaction fees or other service fees for certain activities on the Platform. These fees are displayed at the time of the transaction and are non-refundable. By using the Platform, you agree to pay any applicable fees. Contact our support team for more information.

7. Account Termination

We may suspend or terminate your account at any time for violation of these Terms, fraudulent activity, or any other reason deemed necessary for the safety and integrity of the Platform. If your account is terminated, you may not create a new account without our consent.

8. Disclaimers

No Warranty: The Platform is provided “as-is” and without any warranty, express or implied, including but not limited to the implied warranties of merchantability or fitness for a particular purpose. We do not guarantee that the Platform will be error-free or uninterrupted.

9. Limitation of Liability

In no event shall Artrecast, its affiliates, or its employees be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, arising out of or related to your use of the Platform.

10. Indemnification

You agree to indemnify and hold harmless Artrecast, its affiliates, and employees from any claims, damages, liabilities, and expenses (including legal fees) arising from your violation of these Terms, infringement of third-party rights, or misuse of the Platform.

11. Privacy

Your use of the Platform is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information. By using the Platform, you consent to the collection and use of your information as described in the Privacy Policy
